Dual Occupancy and Duplex Planning

From the first site check to the SEE and subdivision, we plan duplexes that fit the block and pass the council.

Dual occupancy is the most common small development in NSW and the one with the most traps. Minimum lot size, frontage, the difference between attached and detached, whether Torrens title subdivision is allowed, and whether the site qualifies for complying development under the Low Rise Housing Diversity Code all decide the outcome before a line is drawn.

URBA works with owners, builders and designers on duplex projects from the first site check through to the SEE, the subdivision application and any Clause 4.6 request. Since 1 July 2024 dual occupancies are permissible in R2 zones across most of NSW, but the lot size and DCP controls of each council still shape what is achievable.

What is the minimum lot size for a duplex in NSW?

It varies by council and is set in the LEP, often between 450 and 700 square metres for an attached dual occupancy, with larger minimums for detached forms and different figures again for CDC under the Low Rise Housing Diversity Code. We check the exact figure for your site as the first step.

Can I subdivide a duplex into two titles?

Often, but not always. Some LEPs allow Torrens title subdivision of dual occupancies only where each resulting lot meets a minimum area; others permit strata only. The answer sits in the LEP subdivision clauses and we confirm it in writing.

Is a duplex faster through CDC or DA?

CDC is usually faster if the site and design meet every standard in the code. If any standard is missed, DA is the only route. We assess both before recommending one.
